This Act requires certain employers to allow, upon request from their employees, the establishment and administration of workplace safety committees and to recognize the establishment of such committees within five business days. The NY HERO Act has recently updated its guidelines for workplace safety committees. Employers and committees now have specific regulations and responsibilities to adhere to.
Impacted employers are with 10 or more employees performing work in the state of New York. Detailed NY HERO Act is released on New York State - Department of Labor. Effective Date: December 28, 2022.
For NY State employers who are impacted, it is suggested to train managers and HR staff on how to recognize a request from a worksite employee to form a workplace safety committee and what to do if they receive such a request so that the five business day requirement is met.
